Reasonable care on the part of a lawyer is that level of care and skill which, in light of all relevant surrounding circumstances, is recognized as acceptable and appropriate by similar and reasonably careful attorneys.

    Filing a lawsuit against an attorney for negligence is different from filing a complaint about an attorney with The Florida Bar, who disciplines lawyers for violations of the ethical rules established by the Florida Supreme Court that govern lawyers conduct. Damages are not recoverable through the lawyer grievance system.

    A legal negligence lawsuit requires proving that the attorney was negligent and that the negligence was a legal cause of the loss or damage. The requirement of “legal damages” in proving a case of legal malpractice requires proof that what the attorney did wrong more likely than not affected the result of the work he was hired to perform. An attorney is not negligent simply because a judge or jury rules against the client; but, only if the adverse outcome was caused by some negligent conduct by the attorney.
